New Bankruptcy Law Makes It Harder to Stop Foreclosure

When the new bankruptcy law was approved, people didn’t know how to deal with it. It’s supposed to help people to not lose their homes but there are instances where the new bankruptcy law doesn’t help the homeowner at all. There are times when a homeowner is already behind the mortgage payment and even though the collection and payments will stop, in order to file for bankruptcy, the homeowner would have to have do credit counseling first which might take more time than the payment restriction period. Some people would try to search for bankruptcy assistance at this point.

After the period by which the homeowner has received credit counseling, there is a possibility that he or she wouldn’t have his or her home anymore because it had already been sold. Once a home has been sold this automatically means that the homeowner cannot get his or her house back and would not be able to file for bankruptcy anymore to save the house.

When a situation like this happens, a lot of people are not aware of what they should do. Some people panic and just let things happen but this shouldn’t be the case. Some people run to their other family members but if the family members are not aware of what they should do, then they are of no help either. In order to avoid the situation, homeowners should always be aware about the law and what can happen when one misses the mortgage payment.

When people fail to pay their mortgage payment, they might think that they will still be able to pay for the mortgage next month but because of a variety of reasons, there is a possibility that they wouldn’t be able to pay it and this will make the fees and payments rise higher and higher.

It’s a good thing that people can still rely on bankruptcy assistance in situations like this. There are some advisors that people can approach to give them information on what they can do in order to save their home. For instance, there is such a thing as getting a loan restructure from the homeowner’s mortgage company. If the homeowner would be able to do this, there is a chance that he or she would still be able to save their house.

The reason for this is because when a company gets the house, there are things that would have to be repaired and would mean extra payment for the company. It’s not something that a lender would like so the lender will work with the homeowner so that the ownership of the house can go back to the homeowner.

Bankruptcy assistance is very important especially if a homeowner is not aware of what he or she should do. It’s also important that every homeowner is somewhat aware of the consequences that might occur because of mixed payments and fees. People should always know that there is assistance available for those who have had to declare bankruptcy.
